TERMS AND CONDITIONS OF SERVICE

This is a legal agreement (“Agreement”) between you and Jio Institute (“JI”), a multi-disciplinary higher education institution located in Navi Mumbai, India, set up by Reliance Foundation Institution of Education and Research (a section-8 Company founded by Reliance Industries Limited and Reliance Foundation) and having its registered office at 9th Floor, Plot No 222, Maker Chamber IV, East Wing, Jamnalal Bajaj Marg, Nariman Point, Mumbai – 400 021, India. Jio Institute Digital Library is the library owned and operated by JI. The domain jioinstitute.edu.in and its sub-domains are provided by Reliance Foundation Institution of Education and Research and/or its affiliates located at.

By accessing the content from library.jioinstitute.edu.in and exhibits.jioinstitute.edu.in (the “Site” or “portal”) or using any of the services accessible through the Site, you become a user and agree to, and are bound by, the terms and conditions of this Agreement and the accompanying policies stated below for as long as you continue to use the Site. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT OR THE POLICIES, PLEASE EXIT ALL SITES. Certain other services may be provisioned in the future and your use of, or participation in, such services may be subject to additional terms, and such terms will be either listed in this Agreement or will be presented to you for your acceptance when you sign up to use such services.

The Jio Institute Digital Library’s Special Collections services consist of the following, without limitation: a service for (i) searching, accessing, reading, downloading an entire book or literary work or part thereof hosted by Jio Institute Digital Library’s Special Collections; (ii) searching, accessing, reading, downloading an entire book or literary work or part thereof of hosted on non-Jio Institute Digital Library’s Special Collections sites, both domestic and foreign, but authenticated by Jio Institute Digital Library’s Special Collections; (iii) and other interactive content; and (iv) viewing of materials on the Jio Institute Digital Library’s Special Collections Special Library. Jio Institute Digital Library’s Special Collections may offer additional services or revise any of the services, at its discretion, and this Agreement will apply to all additional services or revised Services. Jio Institute Digital Library’s Special Collections also reserves the right to cease offering any of the services of functionality. However, nothing herein imposes any legal obligation on Jio Institute Digital Library’s Special Collections to notify users of such provisioning or withdrawal.

In addition to these Terms, you may be subjected to the terms and conditions of Collpoll provided by Butterfly Innovations Private Limited (available at http://jioinstitute.collpoll.com) for availing student management services. By agreeing to these Terms, you acknowledge and agree to have read, understood and you consent to be governed by the terms of Collpoll for the purposes of accessing student management tool.

Third-party website and/or its contents and services may also be made accessible through the Site. You use and access of such websites indicates your acceptance of the terms and conditions of such third-party website.

This Agreement is subject to change by Jio Institute Digital Library’s Special Collections in its sole discretion at any time and the notice of such change will be communicated to you in a manner Jio Institute Digital Library’s Special Collections deems appropriate, including email. Your continued use of this Site after the posting of revisions to this Agreement means you accept such revisions. Please consult the end of this Agreement to determine when the Agreement was last revised.

By providing the services under the Site, Jio Institute Digital Library’s Special Collections is acting an “intermediary” under the Information Technology Act, 2000 (as amended) and rules thereunder.

1. Eligibility.

a. Minimum Age. You must be at least 13 years old to use the Site. By using the site and/or services, you represent and warrant that you are at least 13 years old. In case a user is under age of consent, parental guidance and consent is assumed through availability of computer resource to access the Site. In case a user is below 13, parental guidance is required to access the Site and services therein.

2. Use of JI and Jio Institute Digital Library’s Special Collections Site

As a user of the Site and/or services, you agree to the following:

a. Exclusive Use. Your account is for your personal use only. Do not allow others to use your account, and you may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Jio Institute Digital Library’s Special Collections is not responsible for third party access to your account that results from theft or misappropriation of your usernames, library or JI identity information, and passwords.

b. Geographic Limitations. The Site and/or services are primarily intended for use by residents of India. You will only use the Site and its contents in a manner consistent with this Agreement and any and all applicable local, state, national and international laws and regulations. Registration for, and use of, the site is void where prohibited. To the extent that content on this Site is not legal in the jurisdiction where you reside, you may not use the services. You further agree to waive any additional remedy provided by any law or regulation in force outside the Republic of India.

c. Risk Assumption and Precautions. By using the site, you understand that you may be exposed to offensive or objectionable content. You agree not to use such content or learnings/teachings therefrom for any wrongful or illegal purposes. You assume all risk when using the Site, including but not limited to all of the risks associated with accessing content written by authors disagreeing with your point of view or having a different narrative.

d. Potentially Harmful Language in Descriptions. Jio Institute Digital Library’s Special Collections library collection and catalogue reflects its focus on acquiring a diversity of various materials which may be evocative of past practices and choices may be viewed or deemed offensive. Some materials in our collections may represent positions, norms, and values that are offensive and objectionable. By providing access to these materials in physical or digital form, Jio Institute Digital Library’s Special Collections recognizes that they can play a vital role in in helping us learn from the past. In addition, please be advised that our collection guides and other catalogue descriptions may occasionally re-use language provided by other creators or former holders of the materials. We strive to place any outdated or offensive terminology in context. We recognize that we may not always make the right decision, and welcome feedback from all sources so we can listen, learn, and adjust our practices.

e. Reporting of Violations. Please promptly report to Jio Institute Digital Library’s Special Collections any violation of the Agreement by others, including but not limited to, Registered Users.

f. Content Removal. Jio Institute Digital Library’s Special Collections reserves the right, but has no obligation, to monitor your use and access of the Site and may remove any such information or material that in its sole opinion violates, or may violate, any applicable law or regulation, either in letter or in spirit of this Agreement, or upon the request of any third party. Further, Jio Institute Digital Library’s Special Collections reserves the right to remove any content from this Site upon a request by any legal authority without notice to the content owner/supplier either prior to such removal or thereafter.

g. Posting and Communication Restrictions. Please do not post anywhere on the Site, transmit to other users, communicate any content (or links thereto), or otherwise display, upload, modify, publish, update, share any information, or engage in any activity on the Site that:

i. Belongs to another person and to which the you do not have any right;

ii. Is grossly harmful, harassing, defamatory, inaccurate, disparaging, hateful, racially or ethnically objectionable, blasphemous, libellous, or promotes bigotry or physical harm;

iii. Is obscene, profane, offensive, pornographic, paedophilic, or otherwise objectionable;

iv. Harms minors in any way;

v. Relates to, solicits, or encourages money laundering or gambling;

vi. Is invasive of another's privacy;

vii. Infringes any patent, trademark, copyright or other proprietary rights including others’ copyrighted content (e.g., music, movies, videos, photographs, images, software, etc.) without obtaining permission first, as well as video, audio, photographs, or images of another person without his or her permission (or in the case of a minor, the minor’s legal guardian), or circumvents copy-protect devices;

viii. Deceives or misleads the addressee about the origin of any message or communicates any information which is grossly offensive or menacing in nature;

ix. Impersonates another person, or otherwise misrepresents affiliation, connection or association with, any person or entity, or obtain others’ identity information;

x. Disseminates another person’s personal information without his or her permission, or collects or solicits another person’s personal information for commercial or unlawful purposes;

xi. Contains software viruses, trojan horses, worms, malware of any sort, or other harmful, or disruptive codes, components or devices or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;

xii. Uses scripts, bots or other automated technology to access the Site;

xiii. Uses the Site to create junk mail or spam e-mails;

xiv. Is in any way used for or in connection with spamming, spimming, phishing, phreaking, trolling, or similar activities;

xv. Promotes or enables illegal or unlawful activities in any manner whatever;

xvi. Is off-topic, meaningless, or otherwise intended to annoy or interfere with others’ use and access of the Site;

xvii. Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting to any other nation.

If you know of any violation of the above clauses [2(d)], please contact the Grievance Officer whose details are mentioned at the bottom of this page.

h. Impermissible Use: Apart from the use and access authorised under this agreement, you agree you shall not:

i. access or secure access to any Jio Institute Digital Library’s Special Collections computer, computer system or computer network contrary for any purpose apart document;

ii. download, copy or extract any data, computer data base or information from such computer, computer system or computer network including information or data held or stored in any removable storage medium;

iii. introduce or cause to be introduced any computer contaminant or computer virus into any computer, computer system or computer network;

iv. damage or causes to be damaged any computer, computer system or computer network, data, computer data base or any other programme residing in such computer, computer system or computer network;

v. disrupt or cause disruption of any computer, computer system or computer network;

vi. deny or cause the denial of access to any person authorized to access any computer, computer system or computer network by any means;

vii. provide any assistance to any person to facilitate access to a computer, computer system or computer network in contravention of the provisions of this Act, rules or regulations made thereunder;

viii. charge the services availed of by a person to the account of another person by tampering with or manipulating any computer, computer system, or computer network;

ix. destroy, delete or alter any information residing in a computer resource or diminishes its value or utility or affects it injuriously by any means; and

x. steal, conceal, destroy or alter or cause any person to steal, conceal, destroy or alter any computer source code used for a computer resource with an intention to cause damage.

i. No False Information. Please do not provide inaccurate, misleading or false information to Jio Institute Digital Library’s Special Collections. If information provided to Jio Institute Digital Library’s Special Collections or another user subsequently becomes inaccurate, misleading or false, you will promptly update such information or notify Jio Institute Digital Library’s Special Collections of such change. 

j. Unique and Bona Fide Profile. As a Registered User of the Site, create only one unique profile. In addition, your use of the Site must be for bona fide intellectual, academic, research or for the purpose of leisure.

k. No Commercial Use. No information acquired for the Site is to be used to be for any commercial purpose. Specifically, information acquired from the site shall not be used for collection, publication, preparing assimilated data, conducting surveys or the like.

l. No Harassment of Jio Institute Digital Library’s Special Collections Employees or Agents. Please do not harass, annoy, intimidate or threaten any Jio Institute Digital Library’s Special Collections employee or agent engaged in providing any portion of the Services to you.

3. Proprietary Rights.

a. Ownership of Proprietary Information. You hereby acknowledge and agree that Jio Institute Digital Library’s Special Collections is the owner of proprietary information within the Site. Such proprietary information does not include any personal information that has been submitted by users.

b. Additional features/programs: From time to time, we may create, test or implement new features or programs on the Site. By your voluntary participation in such features or programs, you grant us the rights stated in this subsection in connection with the additional terms and conditions (if any) of such features or programs.

c. Web Analytics: We may monitor the site performance from time to time and in this regard collect site usage reports, advertisement banner statistics like impressions, click through rate, user demographic reports, usage reports, and other functions. Your use of the Site or Services indicates your consent to such monitoring, collection, possession, and use of such information and statistics.

4. User Information.

a. Privacy Statement. For information about the collection and possible use of information and material provided by you, please click on Jio Institute Digital Library’s Special Collections ’s Privacy Policy located on the Site. By using the Site or the Services, you are consenting to the terms of Jio Institute Digital Library’s Special Collections’ Privacy Policy.

b. Disclosure By Law. You acknowledge and agree that Jio Institute Digital Library’s Special Collections may disclose information you provide if required to do so by law, at the request of a third party, or if we, in our sole discretion, believe that disclosure is reasonable to (1) comply with the law, requests or orders from law enforcement, or any legal process; (2) verify the identity, prevent, detect, investigate, prosecute, and punish offences where the Government Agency has stated in writing that the information obtained shall not be published or shared with any other person; (2) protect or defend Jio Institute Digital Library’s Special Collections ’s, or a third party’s, rights or property; or (3) protect someone’s health or safety, such as when harm or violence against any person (including the user) is threatened.

c. Legal Compliance. Jio Institute Digital Library’s Special Collections, upon receipt of information pertaining to any violation of this agreement, or upon obtaining knowledge by itself, or, being brought to actual knowledge by an affected person in writing or through email signed with electronic signature, shall, within thirty six hours and where applicable, work with user or owner of such information, to disable such information that is in contravention of this agreement or the Information Technology Act, 2000 or its rules there under. Further, Jio Institute Digital Library’s Special Collections shall preserve such information and associated records for at least 180 days for investigation. When required by lawful order, Jio Institute Digital Library’s Special Collections shall provide information or assistance to Government Agencies who are lawfully authorised for investigative, protective, cyber security activity. The information or any such assistance shall be provided for the purpose of verification of identity, or for prevention, detection, investigation, prosecution of cyber security incidents and punishment of offences under any law for the time being in force, on a request in writing stating clearly the purpose of seeking such information or any such assistance.

d. Reporting of Violations. Jio Institute Digital Library’s Special Collections shall report cyber security incidents and also share cyber security incidents related information with the Indian Computer Emergency Response Team.

5. User Contribution.

a. User contributions include, but are not limited to, uploaded documents, comments, reviews, ratings, tags, annotations, and any other form of content provided by users within the digital library.

b. Users are responsible for the content they contribute and should ensure that their contributions align with the guidelines outlined in this policy. They should also comply with relevant laws, intellectual property rights including copyright, and privacy law regulations.

c. Users retain the ownership rights to their contributions. However, by submitting content to the digital library, users grant the library a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, and display their contributions for library-related purposes. Users must use respectful and inclusive language in all their contributions. Discriminatory, offensive, or harassing content will not be tolerated and will be removed. This includes content that promotes hatred, discrimination, or violence based on race, caste, gender, religion, nationality, sexual orientation, or any other protected characteristic.

d. Users are advised to contribute content that they have the necessary rights or permissions to share. Properly attribute sources and provide citations where applicable. Plagiarism or unauthorized distribution of copyrighted material is strictly prohibited. Contributions should be relevant to the library's purpose and should strive for accuracy. Spreading of false, misleading or unverified information is prohibited. If referencing external sources, ensure they are reputable and reliable. Clearly distinguish between personal opinions and factual information.

e. User contributions should not serve as promotional material for personal gain or commercial purposes. Contributions should focus on sharing knowledge, information, and resources that benefit the community. Avoid excessive self-promotion or spamming.

6. Disclaimer of Warranty.

a. No Warranties. THIS SECTION WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. ALTHOUGH JIO INSTITUTE DIGITAL LIBRARY’S SPECIAL COLLECTIONS ATTEMPTS TO PROVIDE USERS WITH AN ENJOYABLE AND ENRICHING EXPERIENCE THROUGH THE USE OF THE SITE, JIO INSTITUTE DIGITAL LIBRARY’S SPECIAL COLLECTIONS PROVIDES THE SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS AND GRANTS NO GUARANTEES OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICES OR THE SITE (INCLUDING ALL INFORMATION CONTAINED THEREIN), INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. JIO INSTITUTE DIGITAL LIBRARY’S SPECIAL COLLECTIONS DOES NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE SECURE, UNINTERRUPTED, ALWAYS AVAILABLE, ERROR-FREE OR WILL MEET YOUR REQUIREMENTS, OR THAT ANY DEFECTS IN THE SERVICES WILL BE CORRECTED. JIO INSTITUTE DIGITAL LIBRARY’S SPECIAL COLLECTIONS DISCLAIMS LIABILITY FOR, AND NO GUARANTEE OR WARRANTY IS MADE WITH RESPECT TO, THE CONNECTIVITY AND AVAILABILITY OF THE SERVICES.

b. Third Party Content. Information or content made available through the Site, but not by Jio Institute Digital Library’s Special Collections are those of their respective authors and should not necessarily be relied upon. Such authors are solely responsible for such content. Jio Institute Digital Library’s Special Collections DOES NOT: (I) GUARANTEE THE ACCURACY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION PROVIDED, OR (II) ADOPT, ENDORSE OR ACCEPT RESPONSIBILITY FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE, OR STATEMENT MADE BY ANY PARTY OTHER THAN JIO INSTITUTE DIGITAL LIBRARY’S SPECIAL COLLECTIONS. UNDER NO CIRCUMSTANCES WILL JIO INSTITUTE DIGITAL LIBRARY’S SPECIAL COLLECTIONS BE RESPONSIBLE FOR ANY LOSS OR DAMAGE RESULTING FROM ANYONE’S RELIANCE ON INFORMATION OR OTHER CONTENT POSTED ON THE SERVICES, OR TRANSMITTED TO OR BY ANY USERS.

c. Beta Features. From time to time, Jio Institute Digital Library’s Special Collections may offer new “beta” features or tools with which its users may experiment on the Services. Such features or tools are offered solely for experimental purposes and without any warranty of any kind, and may be modified or discontinued at Jio Institute Digital Library’s Special Collections’ sole discretion. The provisions of this Disclaimer of Warranty section apply with full force to such features or tools.

7. Limitation of Liability.

a. Incidental Damages and Aggregate Liability. IN NO EVENT WILL JIO INSTITUTE DIGITAL LIBRARY’S SPECIAL COLLECTIONS BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR INDIRECT DAMAGES ARISING OUT OF OR IN RELATION TO THE USE OR INABILITY TO USE THE SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OR CORRUPTION OF DATA OR PROGRAMMES, SERVICE INTERRUPTIONS, AND PROCUREMENT OF SUBSTITUTE SERVICES, EVEN IF JIO INSTITUTE DIGITAL LIBRARY’S SPECIAL COLLECTIONS KNOWS OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES WILL JIO INSTITUTE DIGITAL LIBRARY’S SPECIAL COLLECTIONS’ AGGREGATE LIABILITY, IN ANY FORM OF ACTION WHATSOEVER IN CONNECTION WITH THIS AGREEMENT OR THE USE OF THE SERVICES OR THE SITE, EXCEED RUPEES ONE THOUSAND ONLY.

b. No Liability for non-JIO INSTITUTE DIGITAL LIBRARY’S SPECIAL COLLECTIONS ACTIONS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL JIO INSTITUTE DIGITAL LIBRARY’S SPECIAL COLLECTIONS BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATION WITH THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SERVICES, INCLUDING WITHOUT LIMITATION, HURT (AS DEFINED IN THE INDIAN PENAL CODE, 1860), EMOTIONAL HARM OR DISTRESS, MONETARY OR SOCIAL LOSS/ INJURY, AND/OR ANY OTHER DAMAGES RESULTING FROM COMMUNICATIONS, ASSOCIATIONS, OR MEETINGS WITH OTHER USERS OF THE SERVICES. THIS INCLUDES ANY CLAIMS, LOSSES OR DAMAGES ARISING FROM THE CONDUCT OF USERS WHO HAVE REGISTERED UNDER FALSE PRETENSES OR WHO ATTEMPT TO DEFRAUD OR HARM YOU.

8. Indemnification.

You agree to indemnify, defend and hold harmless Jio Institute Digital Library’s Special Collections , its promoters, officers, directors, employees, agents and third parties, for any injury, losses, costs, liabilities and expenses (including legal expenses) relating to or arising out of (a) your use of or inability to use the Site or Services, (b) any user postings made by you, (c) your violation of any terms of this Agreement or your violation of any rights of a third party, or (d) your violation of any applicable laws, rules or regulations. Jio Institute Digital Library’s Special Collections reserves the right, at its own cost, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Jio Institute Digital Library’s Special Collections in asserting any available defences.

9. Complaints / Law Enforcement Contact.

To resolve a complaint regarding the Service, you should review our Frequently Asked Questions (FAQ) by clicking on the FAQ’s link located at the bottom of any page of the Site, or Contact Us. Law enforcement officials may send correspondence (such as requests under the Information Technology Rules and Court Orders) to Jio Institute Digital Library’s Special Collections at its Registered Address.

10. Communication and Privacy.

We may use your email address to send you messages notifying you of important changes to the Services or special offers. Also, we may contact you by telephone if you voluntarily provide us with your telephone number, in order to communicate with you regarding the Services. By signing up for the services, you grant us express consent to contact you regardless of whether your number is listed in the National Do No Call Registry (NDNC registry) maintained by the Telecom Regulatory Authority of India. You further expressly agree that any SMS, voice call, WhatsApp received from Jio Institute Digital Library’s Special Collections /JI is not Unsolicited Commercial Communication (UCC) as defined in Telecom Unsolicited Commercial Communications Regulations, 2007.

11. Term and Termination.

This Agreement will become effective upon your acceptance of the Agreement by your use of the Site and will remain in effect in perpetuity unless terminated hereunder. Either you or Jio Institute Digital Library’s Special Collections may terminate your account at any time, for any reason, effective upon sending written notice to the other party. Jio Institute Digital Library’s Special Collections reserves the right to immediately suspend or terminate your access to any of the Services, without notice, for violation or non-compliance with Clause 2 or any other part of this agreement. If you know of any person who has violated Clause 2 of this agreement, please contact the Grievance Officer whose details are mentioned at the bottom of this page. We also reserve the right to remove any non-compliant information, your account information or data, and any other records from our Site at any time at our sole discretion. You further agree that in the event of termination of account, some account information may be held in backups and some personal information may continue to be kept with Jio Institute Digital Library’s Special Collections for a reasonable period of time. You may terminate your account by following the steps in the applicable section under “Termination” below, or by sending a notice of cancellation to: Grievance Officer.

12. Termination.

a. Termination. Except as otherwise stated in this section, you may cancel your registration at any time by accessing the “Profile” page on your membership home page and clicking on the “Deactivate Your Jio Institute Digital Library’s Special Collections Account” link, and providing the information requested. In such case, your registration would be terminated at the end of seven working (7) days.

b. Cancellation Due to Death. In case of death, your account will be closed immediately upon notice and all personal information may be subsequently deleted. If you are a legal representative of the account holder, please send us a signed affidavit stating clearly your name, contact information, relation to the deceased account holder, a request for deletion of the account, and a notarized copy of the death certificate. Please note that in case of requests from law enforcement authorities, the deletion of personal and/or account information may be postponed to such time till Jio Institute Digital Library’s Special Collections determines in its sole discretion to be necessary.

13. General Provisions.

 

a. Applicable Law and Jurisdiction. This agreement and this Site is governed under the laws of the Republic of India (without giving effect to conflicts of law principles). Any dispute arising out of or in relation to this Agreement, the Site will be subject to the exclusive jurisdiction and venue of the courts of Mumbai. You acknowledge and agree that any violation of this Agreement may cause Jio Institute Digital Library’s Special Collections irreparable harm, and therefore agree that Jio Institute Digital Library’s Special Collections will be entitled to seek extraordinary relief in court, including but not limited to, preliminary injunctions and permanent injunctions, damages without the necessity of depositing any amount as security in addition to and without prejudice to any other rights or remedies that Jio Institute Digital Library’s Special Collections may have for a breach of this Agreement.

b. Grievances, Claims and Disputes. In case of any claim, dispute, or controversy, between you and Jio Institute Digital Library’s Special Collections, the parties shall try and amicably resolve the dispute or controversy. You shall approach Jio Institute Digital Library’s Special Collections with such grievance or claim and Jio Institute Digital Library’s Special Collections will endeavour to address any issue. In the event the parties fail to resolve the issue between themselves, the parties shall jointly appoint a mediator or a legal practitioner to mediate such issue. However, parties agree not to use arbitration as an alternative remedy.

c. Legal Proceedings. No promoter, director, officer, or employee shall be impleaded as a party to any litigation or legal proceedings instituted against Jio Institute Digital Library’s Special Collections.

d. Miscellaneous.

  • This Agreement, which you accept upon registration for the Site, the Privacy Policy, the Copyright Policy, located on the Site, comprise the entire agreement between you and Jio Institute Digital Library’s Special Collections regarding the use of this Service, superseding any prior agreements between you and Jio Institute Digital Library’s Special Collections related to your use of this Site or Services (including, but not limited to, any prior versions of this Agreement).
  • The FAQ’s found on the Site are for informational purposes only and are not deemed to be part of this Agreement.
  • Unless otherwise explicitly stated, the Agreement will survive termination of your registration to the Service. The failure of Jio Institute Digital Library’s Special Collections to exercise or enforce any right or provision of this Agreement does not constitute a waiver of such right or provision. If any provision of this Agreement is held invalid, the remainder of this Agreement will continue in full force and effect. Regardless of any law or regulation to the contrary, any claim or cause of action arising out of or related to the use of the Site or this Agreement must be filed within six (6) months after such claim or cause of action arose or be forever time-barred.
  • The section titles in this Agreement are for convenience only and have no legal or contractual effect.

With regard to our users and employees, we strive to guarantee that human rights are exercised without discrimination of any kind based on sex, caste, nationality, race, colour, language, religion, political or other opinion, national or social origin, property, birth or other status such as disability, age, marital and family status, sexual orientation and gender identity, health status, place of residence, economic and social situation.
